Research Question: Draft

To what extent is it fair to say that America’s fashion industry is unprotected by intellectual property law because much of the industry and American consumers thrive on inexpensive knockoffs?

    I’m also working on intellectual property law in regards to fashion industry. After doing the concept map homework, I realized how many different ways products can be termed as ‘knockoffs.’ For your question, you have a good focus of where you want to direct your attention to, the level to which America’s fashion industries are affected. However, when you say ‘inexpensive knockoffs,’ do you mean fake products (fake bags, clothes… etc) or retail clothing stores that sell trendy but cheaper clothes (Forever 21, H&M… etc)? Either option greatly impact the fashion industry. Selling counterfeits is illegal in America but for stores like Forever 21, there isn’t a set law that stop these stores from copying original fashion designers. That’s a question I need to specify on as well.

  2. I think Julie’s question about inexpensive knockoffs is a good one and worth keeping in mind as you work on the final project.
