Lesson One-Shared Resource- Repeal of 1954 Johnson Amendment

The New York Times, on February 2, 2017 reported that President Trump will take action to repeal the 1954 Johnson Amendment which essentially mandates that in order for an organization they must be non-partisan in order to receive and maintain 501C3 status.  This action would fulfill a campaign promise allowing non-profit organizations to support and publicize political candidates and agendas.

Organizations such as the National Council of NonProfits have been spearheading efforts against the proposed bill that would negate or at least weaken the 1954 Johnson Amendment, particularly addressing the portion of the 501 C3 tax code:”and which does not participate in, or intervene in (including publishing or distributing of statements), any political campaign on behalf of (or in opposition to) any candidate for public office.” One concern is that in weakening the amendment, donors can be empowered to pressure non-profit organizations to support political agendas.  Another concern is that as some charitable organizations in particular churches which currently are not required to file 990s, Trump’s proposed bill could render their financial activities to be under stronger scrutiny by the IRS.
