Carlos Slim’s Company Contests $138.5 Million Fine Issued in Ecuador por Diandra Pierce

The Conecel company, owned by América Móvil, contested the $138.5 million fine that was imposed by the Superintendencia de Control del Poder de Mercado de Ecuador to consider that Carlos Slim’s company exercised “abuse of market power” in 2012, and they announced in their defense they will exercise resources that the law contemplates.
In an official release, Conecel indicated that the fine is unjust and that it responds to an impeachment of the CNT (Corporación Nacional de Telecomunicaciones) state workman that refers to 5 plots of land (of the thousands that Conecel leases) and which CNT alleges that they were not able to expand their network. In the same zones in which those 5 plots of land are at, options exist and alternative areas, equally fit, in which the required infrastructure can be installed. This has not happened so the entry gate neither limits either operator.
The company that operates in Ecuador as Claro’s subsidiary considered that “the magnitude of the fine is disproportionate, violates the constitutional principle of proportionality, and affects the juridical security in which it sustains the inversion process.”
“Conecel will exercise resources that the law contemplates, to finally earn a lawful, agreeable resolution that guarantees the right process within a juridical framework.
